Análise comparativa das leis 14.133/2021 e a lei 8.666/1993: novas formas, tipos e etapas da licitação pública.

Abstract

This research deals with the legislation that governs the bidding process in which the contracting of works, services, purchases and disposals by the Public Authority will be carried out, which, by express constitutional provision, must as a rule be preceded by a bidding process. However, after 30 years of using Law No. 8.666/1993, in 2021 the new Law No. 14.133 was approved, to be implemented by the government in 2023. The research aims to analyze the main changes and innovations in the scope of bidding processes with the advent of Law No. 14.133/2021 in relation to Law No. 8.666/1993. The research method in relation to comparative documentary technical procedures based on the dictates of legislation 8.666/1993 and 14.133/2021, doctrine and jurisprudence. This study hopes that the change in the law will unify the rules and that this novelty of inserting the competitive dialog modality will be an instrument for transparency, speed, effectiveness and legal certainty in the bidding process currently governed by Law 14.133/2021 to guarantee applicability in contracting.
